United States law requires employers to verify an employee’s eligibility to accept employment in the United States through the use of Form I-9. In addition to requiring each employee to complete an I-9 prior to beginning employment with a company, the law requires the employer to maintain these forms, request supplemental documentation from the employee, and keep records of the I-9s. Non-compliance can result in administrative fines and at times, criminal prosecution.
Our firm will assist the employer by providing sound legal advice and a comprehensive plan for complying with their I-9 obligations. In addition, should U.S. investigators wish to audit a company’s I-9 records, we will represent the company’s interests during the audit.
Where a company previously has not complied fully with the I-9 requirements, our firm will zealously advocate for the company in both administrative and/or criminal proceedings and help bring the company into compliance.
